Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Rideshare Companion (the "App") on mobile or accessing the web platform at rideshare-companion.ro (the "Website"), you agree to be bound by these Terms of Service. The App and Website are collectively referred to as the "Service". If you do not agree, do not use the Service.

2. Description of Service

Rideshare Companion is a platform for rideshare drivers operating in Romania. The Service provides the following features across mobile and web:

• Platform Integrations — Connect your Uber and Bolt driver accounts to sync orders, earnings, vehicle data, and trip history automatically.
• Earnings Analytics — Compare earnings, orders, distance, and efficiency across Uber and Bolt side by side.
• Surge Prediction — Real-time demand heatmap powered by AI that predicts surge zones up to 7 days ahead.
• Income Simulator — Compare PFA, SRL, and CIM tax structures to find the optimal legal setup for your income.
• Cash Register — Connect your fiscal cash register, issue receipts, and generate Z/X fiscal reports from your phone.
• Trip Sheets — Generate daily ARR-compliant trip sheets with auto-imported ride data, digital signature, and PDF export.
• Document Management — Track vehicle documents (ITP, insurance, ARR authorization) with expiration alerts and reminders.
• Fleet Marketplace — Browse, compare, and rent rideshare-ready vehicles from registered fleet companies; fleet owners can list their companies and manage driver applications.
• Chat — Real-time messaging with other drivers in topic rooms and direct messages.
• ARR Quiz — Practice for the ARR alternative transport exam with multiple testing modes and up-to-date questions.
• ARR Document Generation — Auto-generate the applications and declarations needed for ARR authorization.
• Driver Guide — Step-by-step guide from certification to first ride.
• Weather & Event Alerts — Push notifications for severe weather conditions and high-demand events in your area.
• Gamification — XP system, streaks, and achievements to track your driving milestones.
• Referral Program — Earn rewards by inviting other drivers to the platform.
• Blog & Content — Articles and resources about the Romanian rideshare industry.
• Partner Discounts — Exclusive offers from partners for fuel, car wash, insurance, and more.
• Expense Tracking — Log expenses with automatic TVA computation and invoice management with OCR scanning.

3. User Accounts

To use certain features you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You may sign in with Google, Apple, or Facebook. By doing so, you authorize us to access basic profile information (name, email, profile photo) from those providers. You can delete your account at any time from the App's Account settings or by emailing us.

4. Platform Integrations (Uber & Bolt)

The Service allows you to connect your Uber and/or Bolt driver accounts. By authorizing these connections you understand and agree that:

• We access your order history, earnings data, vehicle information, and trip details through the respective platform APIs.
• We store this data securely in our systems to provide analytics, trip sheets, and earnings comparison features.
• We do not modify, create, or cancel any orders or settings on your Uber or Bolt accounts.
• You can disconnect a platform integration at any time from the App's Account settings. Upon disconnection, we stop fetching new data but may retain previously synced data for your records unless you request its deletion.
• We are not affiliated with, endorsed by, or sponsored by Uber Technologies, Inc. or Bolt Technology OÜ. The Uber and Bolt names and logos are trademarks of their respective owners.

5. Location Services

The App may request access to your device's location services. Location data is used for surge prediction heatmaps, nearby event detection, airport/train station arrival predictions, weather alerts, and trip tracking. Background location is used only when explicitly enabled by you for active trip tracking. You can disable location services at any time through your device settings, though this may limit functionality.

6. Fleet Marketplace

The Fleet Marketplace connects fleet owners with drivers looking to rent vehicles. By using the marketplace:

• For fleet owners: You are responsible for the accuracy of your fleet listing, vehicle details, pricing, and availability. You must have the legal authority to rent out the vehicles you list.
• For drivers: The Service facilitates discovery and initial contact. All rental agreements, payments, vehicle handovers, and disputes are between you and the fleet owner. Rideshare Companion is not a party to any rental transaction.
• Reviews and ratings must be honest, factual, and related to the fleet experience. We reserve the right to remove reviews that violate these guidelines.
• We do not verify the legal status, insurance coverage, or roadworthiness of listed vehicles. Always verify these independently.

7. Chat & User-Generated Content

The Service includes a real-time chat feature with topic rooms and direct messages. By using chat:

• You are solely responsible for the content of your messages.
• Messages are retained for 3 days and then automatically deleted.
• You must not post illegal content, harassment, spam, personal information of others, or content that violates any applicable law.
• We reserve the right to suspend or ban chat access for users who violate community guidelines.
• Chat moderation is handled by designated community administrators.

8. Subscription and Payments

Some features require a paid subscription. Subscription fees are billed through the Apple App Store or Google Play Store. You can manage or cancel your subscription through your device's app store settings. Features behind the subscription may change over time as we add and reorganize capabilities.

The referral program provides rewards (such as extended trial periods or feature access) for successful referrals. Reward terms may change and will be communicated within the App.

9. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Scrape, crawl, or use automated tools to extract data from the Service
• Interfere with or disrupt the Service's functionality
• Reverse engineer or decompile the App
• Share your account with others or create multiple accounts
• Post false, misleading, or fraudulent fleet listings or reviews
• Use the chat to distribute spam, advertisements, or malicious content
• Manipulate surge prediction data or gamification metrics
• Use the ARR quiz content or document templates for commercial redistribution

10. Intellectual Property

The Service and its original content, features, design, and functionality are owned by ELARYSOFT SRL and are protected by international copyright, trademark, and other intellectual property laws. The ARR quiz questions are sourced from publicly available examination materials. Uber and Bolt are trademarks of their respective owners. Rideshare Companion is an independent tool and is not affiliated with Uber or Bolt.

11. Accuracy of Information

While we strive for accuracy, the Service provides tools and information on an "as-is" basis. Earnings data, surge predictions, tax simulations, and trip sheet calculations are estimates and should not be treated as financial, tax, or legal advice. Always consult a qualified professional for financial and legal decisions. The income simulator is an educational tool and does not replace professional accounting services.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be error-free, uninterrupted, secure, or available at all times. Platform integration data (Uber/Bolt) depends on third-party APIs that may change or become temporarily unavailable without notice.

13. Limitation of Liability

To the maximum extent permitted by law, ELARYSOFT SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages arising from reliance on earnings data, surge predictions, tax simulations, fleet marketplace transactions, or any disruption in platform integrations.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising from or relating to these Terms shall be resolved in the courts of Bucharest, Romania, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the App, Website, or via email. Continued use of the Service after changes constitutes acceptance of the new terms. If you disagree with any changes, you should stop using the Service and delete your account.
